An independent contractor is classified by the IRS under 26 CFR 31.3121 (d)-1 as a person engaged in the following activities: the most important clause of this contract should be a declaration that that person is an independent contractor and not a worker. It is important that you and the independent contractor understand the nature of the relationship and the fact that they are responsible for paying their own income tax and social security/Medicare taxes. Before hiring an independent contractor, you need three important documents: in particular, the following occupations are independent contractors under IRS rules: If the person working for you is an independent person, you must have them fill out a W-9 form and you must complete a 1099-MISC, both forms can be easily downloaded from the IRS website. The W-9 collects its contact information and identification number. The 1099-MISC is how they report income on their income tax return. You are obliged to do so if you pay more than $600 within one year. To complete your IRS requirement, you must submit the completed Form 1099 to the IRS and the contractor by January 31 of the following year. Independent contractors must use IRS Form 1099 – MISC and submit their taxes to the Internal Revenue Service (IRS) at the end of the year. The first distinction to be made in these contracts is that they do not apply to workers.
There is an agreement between you (or your company) and an independent or independent employee. Some examples are that you pay a craftsman to install new windows in your home, or you hire a free-lance webdesigner to create your company`s website, or you contract with a painter to paint your new offices. They are self-employed and, since they are not salaried, the self-employed are responsible for most of their own tax obligations. Because they are not employees, you can`t stop them from taking over other clients, telling them exactly how to do their job or dictating their daily schedule. An independent contract, also known as the 1099 agreement, is a contract between a customer willing to pay for the provision of services by a contractor.
